At Qyre, we want to give you the best possible experience to ensure that you enjoy our services and products. To do this we need to understand your habits so we can deliver an exceptional and personalized service specifically for you.

In this privacy and cookie policy (the "Policy"), Qyre explains how your personal data is processed when you; (i) use the Qyre Services, (ii) create an account and visit our mobile application and Qyre's website (the "site"), (iii) participate in contests, surveys, events and other marketing activities arranged by Qyre, and (iv) in any other way comes in contact with us, e.g. via our customer service. It is important to us that you feel confident that we treat your personal data with due care, and we encourage you to take the time to read this Policy carefully.

Qyre AB ("Qyre") is the data controller only for the processing carried out on our own behalf as explained below. For other processing activities, i.e. when you interact with other users, create productions, manages productions, etc. you (and every other user, respectively) are considered a data controller for your own processing activities. We are a data processor, acting on your behalf, in such processing activities. Qyre is the data controller only for certain types of data processing, such as usage data, metadata and analytics to improve the platform. For all data added or generated by users within productions (e.g. crew information, schedules, or bookings), Qyre acts solely as a data processor on behalf of the relevant user or organization, in accordance with our Data Processing Agreement (Available upon request legal@qyre.com). Such processing solely consists of storing the data added to or generated by the use of the site and managing the site so that it is available for you and all other users. If you have any questions about our processing, you are welcome to contact us via the contact details in Section 12 below.

If you have any questions about how a specific user/production company is using your data, please reach out to that specific user/production company.
2. Your rights and your preferences: Giving you choice and control

The General Data Protection Regulation or "GDPR" gives certain rights to individuals in relation to their personal data. Accordingly, we are happy to offer transparency and access controls to help users take advantage of those rights. As available and except as limited under applicable law, the rights afforded to individuals are:

  • Right of access – i.e. a right to obtain information about what personal data is processed about you and a copy of the personal data undergoing processing
  • Right to rectification – i.e. a right to have incorrect data corrected
  • Right to erasure – i.e. a right to have your personal data deleted
  • Right to restriction of processing – i.e. a right to request that the processing is restricted, for example if you contest the accuracy of the personal data processed
  • Right to object to the processing of your personal data
  • Right to data portability – i.e. right to request that your personal data is being transferred to another company
  • Right to withdraw your consent to the extent personal data is processed on the basis of your consent (a withdrawal will however not affect the lawfulness of processing based on your consent before it is withdrawn)
  • Right to lodge a complaint with a supervisory authority if you consider that the processing does not comply with the applicable data protection legislation

If your request concerns data controlled by another user or organization (e.g. a production company), we recommend that you contact them directly. If you're unsure who the controller is or need assistance, you are always welcome to contact our Data Protection Officer at legal@qyre.com. 3. Description of the Categories of personal data Processed by Qyre

Qyre process the following categories of personal data related to you:

User Data

This is the personal data that is provided by you or collected by us to enable you to sign up for and use the Qyre Services. Such data may include:

  • Name and contact details (your username, email address, phone number, birth date, address and country);
  • Your location (GPS) provided that you have activated that function yourself;
  • Area of practice, previous experience, work and projects as well as verifications given by other users;
  • Other information that you may choose to add to your profile, such as for example access to your phonebook, personal preferred day rates, availability etc.

Usage Data

This is the personal data that is collected about you when you’re accessing and/or using the Qyre Services, including:

  • Chat data, i.e. any information provided by you in connection with using the chat functionality in the Qyre Services.
  • Information about your interactions with the Qyre Services such as the productions you participated in, statistics about the production that you participated in and tasks in such a production as well as interactions with other Qyre users;
  • Inferences drawn about your interests and preferences based on your usage of the Qyre Services;
  • User content you post to Qyre, such as pictures, videos, and interactions with the Qyre Customer Service team.  Please note that we will only access your camera, videos or pictures from your device if you give us permission to do so, and we will only access  images that you specifically choose to share with us and metadata related to  those images, such as the type of file and the size of the image. We will never scan or import your device’s photo library or camera roll;
  • Certain technical data, which may include:
    • URL information and online identifiers including cookie data and IP addresses;
    • Information about the types of devices you are using such as unique device IDs, network connection type (e.g. Wi-Fi, 3G,  LTE, Bluetooth), provider, network and device performance, browser type,  language, information enabling digital rights management, operating system, and Qyre application version; and
    • Your non-precise location, which may be derived or inferred from certain technical data (e.g. your IP address, language setting of your device, or payment currency), to comply with geographic requirements in the services, and deliver personalized content and advertising to you

Payment and Purchase Data
We may collect certain personal data if you make purchases through the Qyre Services. The exact personal data collected will vary depending on the payment method (e.g. direct via the site or by invoice) but will include information such as:

  • Name 
  • Date of birth
  • Credit or debit card type, expiration date, and certain digits of your card number
  • Postal code
  • Mobile phone number
  • Organization number
  • Details of your purchase and payment history

Contests, surveys, events, etc.

When you complete any forms, respond to a survey or questionnaire, or participate in a contest, we process the personal data you provide to us in connection with such activity.

When you use or interact with the Qyre Services, we use a variety of technologies to process the personal data we collect about you for various reasons. 5. Sharing your personal data
5.1 Publicly available information

The personal data processed by Qyre (both user data and usage data, except for technical data such as IP address etc.) is shared with other users on the site as the information uploaded to your profile is displayed to all users. Production companies may search for other users based on areas of practice and other parameters, such as location, and will get access to statistics about productions you have participated in (such as for what time period you have been involved in the production).

5.2 Service Providers
Qyre has engaged several external partners and suppliers to perform services on behalf of Qyre, e.g. to provide customer service and support, provide IT services (e.g. operate the technical infrastructure of the site), assist in protecting and securing our systems and services and assist in marketing (incl. marketing activities) analysis and statistics. Companies which are processing personal data on behalf of Qyre are obliged to sign an agreement with Qyre in order to ensure a high level of protection of personal data. 
5.3 Others

Qyre may also share your personal data with the following partners;

  • Payment processors: We will share your personal data with our payment processors as necessary to enable them to process your payments, and for anti-fraud purposes.
  • Advertising partners: We work with advertising partners to enable us to customize the advertising content you may receive related to the Qyre Services. 
  • Other Qyre Group companies; We will share your personal data with other Qyre group companies to carry out our daily business operations and to enable us to maintain and provide the Qyre Services to you.
  • Law enforcement and data protection authorities: We  share your personal data when we in good faith believe it is necessary for us to do so in order to comply with a legal obligation under applicable law, or respond to valid legal process, such as a search warrant, a court order, or a  subpoena.
  • Purchasers of our business: We will share your personal data in those cases where we sell or negotiate to sell our business to a buyer or prospective buyer. In this situation, Qyre will continue to ensure the confidentiality of your personal data and give you notice before your personal data is transferred to the buyer or becomes subject to a different Policy.
6. Data retention and deletion

We retain your personal data only for as long as necessary to provide you with the Qyre Services and to fulfill legitimate and essential business purposes – such as ensuring service performance, developing new features, complying with legal obligations, and resolving disputes. In general, we store your data for as long as your Qyre account is active. Upon termination of your account or service agreement, we will delete or anonymize your personal data within 90 days unless otherwise required by law, in accordance with our Data Processing Agreement. If you request, we will delete or anonymize your personal data so that it no longer identifies you, unless we are legally allowed or required to maintain certain personal data, including situations such as the following:

  • If there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute we will retain the necessary personal data until the issue is resolved;
  • Where we need to retain the personal data for our legal, tax, audit, and accounting obligations, we will retain the necessary personal data for the period required by applicable law; and/or;
  • Where necessary for our legitimate business interests such as fraud prevention or to maintain the security of our users.
7. Transfer to other countries

We may transfer your personal data to trusted sub-processors or partners located in countries outside the EU/EEA. This includes services related to hosting, communication, analytics, and support. In all such cases, we ensure that the transfer is carried out in accordance with the GDPR. When data is transferred outside the EU/EEA, we rely on:

  • Standard Contractual Clauses (SCCs) adopted by the European Commission
  • The EU–U.S. Data Privacy Framework (DPF), where applicable
  • Additional technical and organizational safeguards, where necessary

8. Links
We may display advertisements from third parties and other content that links to third-party websites. We cannot control or be held responsible for third parties’ privacy practices and content. If you click on a third-party advertisement or link, please understand that you are leaving the Qyre Services and any personal data you provide will not be covered by this Policy. Please read their privacy policies to find out how they collect and process your personal data.
9. Children
The Qyre Services are not directed to children under the age of 13, nor to individuals whose age makes it illegal to process their personal data without parental consent under the GDPR or other applicable laws. We have implemented technical restrictions to prevent registration by such individuals. If we become aware that we have unintentionally collected personal data from a child under 13, we will promptly delete the data and, if necessary, the associated account.
10. Cookies

The Qyre website uses cookies to give you the best possible experience. We only place non-essential cookies (e.g. for analytics or marketing) after you have actively provided your consent through our cookie banner. You may withdraw or modify your consent at any time through your browser settings or via the cookie settings available on our website. You consent to our use of cookies by clicking the cookie banner and using the site. You can withdraw your consent at any time by blocking cookies in your browser settings. In your browser settings you can also delete cookies already stored. Exactly how cookies are deleted/blocked varies between different browsers but please see more information on how to delete/block cookies in your browser instructions or help function. Please note that deleting/blocking cookies may affect your user experience or result in not getting access to all functions on the site.
